General Terms and Conditions of Use

1. Introduction

1.1. “Epaatt” is the trading name of Epaatt Technologies Limited (referred to as “Epaatt”, “we”, “us” or “our”), which operates an e-commerce platform accessible via website and related digital channels (the “Platform”).

1.2. Epaatt provides a curated online platform for the sale and purchase of fashion accessories including, but not limited to, eyeglasses, wristwatches, headsets, and related accessories (the “Products”) within Nigeria.

1.3. These Terms and Conditions apply to all users of the Platform, including buyers and sellers, and govern your access to and use of the Platform and related services.

1.4. By accessing or using the Platform, you agree to be bound by these Terms and Conditions in full. If you do not agree, you must not use the Platform.

1.5. If you use the Platform on behalf of a business or other legal entity, you confirm that:

  • you have the authority to bind that entity;
  • both you and the entity agree to these Terms; and
  • references to “you” include both the individual and the entity, where applicable.

2. Registration and User Accounts

2.1. You must be at least 18 years old to create an account or make purchases on Epaatt.

2.2. When you register, you agree to:

  • provide accurate and complete information;
  • keep your login details confidential;
  • notify us immediately of any unauthorized access to your account; and
  • accept responsibility for all activities carried out through your account.

2.3. Accounts are personal and non-transferable. You may not sell, assign, or allow third-party access to your account without our consent.

2.4. Epaatt reserves the right to suspend or terminate any account at its discretion, including where there is suspected fraud, misuse, or breach of these Terms.

3. Sale of Products

3.1. The Platform provides an online environment where:

  • buyers can purchase Products; and
  • Epaatt may act as the seller and/or facilitate sales on behalf of approved third-party sellers.

3.2. A binding contract for the sale of a Product is formed once an order is confirmed on the Platform.

3.3. Product prices:

  • are displayed clearly on product pages;
  • include applicable taxes unless stated otherwise; and
  • exclude delivery fees unless expressly stated.

3.4. Sellers warrant that Products:

  • are of satisfactory quality;
  • match their descriptions;
  • are lawful to sell in Nigeria; and
  • do not infringe third-party intellectual property rights.

4. Returns and Refunds

4.1. Returns and refunds are governed by Epaatt’s Returns & Refunds Policy, available on the Platform and subject to Nigerian consumer protection laws.

4.2. Refunds may be issued via:

  • original payment method;
  • store credit; or
  • other methods determined by Epaatt.

4.3. Certain items, including hygiene-sensitive products, customized items, or digital products, may be non-refundable unless defective or incorrectly delivered.

4.4. Policy updates apply to all purchases from the date of publication.

5. Payments

5.1. All payments must be made using approved payment methods displayed on the Platform.

5.2. You agree to provide accurate billing information and authorize us to charge the applicable amount.

6. Store Credit

6.1. Epaatt may offer store credits, vouchers, or promotional rewards subject to specific terms.

6.2. Store credits are non-transferable, have no cash value, and may be revoked in cases of abuse or fraud.

7. Promotions

7.1. Promotions, discounts, and campaigns are subject to separate terms which will be clearly stated at the time of each promotion.

8. User Content

8.1. “User Content” includes reviews, comments, feedback, images, and other materials submitted on the Platform.

8.2. You agree that your content:

  • is accurate and lawful;
  • does not mislead or deceive;
  • is respectful and non-offensive.

8.3. Prohibited content includes material that is:

  • fraudulent, abusive, hateful, obscene, or defamatory;
  • misleading or fake (including fake reviews);
  • infringing intellectual property or privacy rights.

8.4. Epaatt reserves the right to remove or edit User Content at its discretion.

9. License to Use Content

9.1. By submitting content, you grant Epaatt a non-exclusive, royalty-free, worldwide license to use, reproduce, publish, and distribute such content for marketing and operational purposes.

10. Use of the Platform

10.1. You may use the Platform for lawful personal or business purposes related to buying or selling Products.

10.2. You must not:

  • misuse the Platform;
  • attempt unauthorized access;
  • scrape data;
  • distribute malware; or
  • interfere with platform security or performance.

11. Intellectual Property

11.1. All Platform content, logos, designs, and materials belong to Epaatt or its licensors.

11.2. You may not use Epaatt trademarks or branding without written permission.

12. Privacy & Data Protection

12.1. Personal data is processed in accordance with Epaatt’s Privacy Policy, compliant with Nigerian data protection laws.

12.2. Sellers are responsible for safeguarding buyer data and using it only for order fulfillment.

13. Compliance & Due Diligence

13.1. Epaatt reserves the right to conduct verification checks to prevent fraud, money laundering, or misuse.

13.2. You agree to provide reasonable information upon request.

14. Platform Availability & Liability

14.1. Epaatt does not guarantee uninterrupted access to the Platform.

14.2. We may modify, suspend, or discontinue services at any time, with reasonable notice where possible.

14.3. Epaatt does not guarantee sales volume, visibility, or commercial success.

15. Limitation of Liability

15.1. To the maximum extent permitted by law:

  • Epaatt shall not be liable for indirect or consequential losses;
  • liability shall not exceed the amount paid for the affected transaction.

16. Indemnity

16.1. You agree to indemnify Epaatt against claims arising from:

  • misuse of the Platform;
  • breach of these Terms; or
  • violation of applicable laws.

17. Breach & Termination

17.1. Breach of these Terms may result in:

  • suspension or termination of account;
  • restriction of access; or
  • legal action.

18. Entire Agreement

18.1. These Terms constitute the entire agreement between you and Epaatt regarding Platform use.

19. Changes to Terms

19.1. Epaatt may update these Terms at any time.
19.2. Continued use constitutes acceptance of updated Terms.

20. Governing Law & Jurisdiction

20.1. These Terms are governed by the laws of the Federal Republic of Nigeria.
20.2. Nigerian courts shall have exclusive jurisdiction.
